Teletrabajo: Nómadas Digitales

Abstract

El presente Trabajo de Fin de Grado procura estudiar la regulación actual del teletrabajo en general y de los nómadas digitales en concreto, a la par que analizar los motivos sociales que están influyendo en las decisiones de los nómadas a la hora de elegir un destino para realizar su actividad profesional. De esta manera se podrá llegar a comprender mejor este nuevo paradigma laboral que crece a pasos agigantados. Y es que, entre el aumento de teletrabajo propiciado por las recientes crisis sanitarias, el surgimiento de cada vez más trabajos nuevos relacionados con las tecnologías, la facilidad que hay hoy en día para viajar a todos los países del mundo y cada vez más cómoda la accesibilidad para conseguir visados o permisos de residencia para vivir en diferentes países, hacen de manera importante, más personas se unan a esta nueva forma de vivir. Primero se hablará sobre las definiciones del teletrabajo y de los nómadas digitales y a continuación se comenzará con el régimen jurídico que regula los nómadas digitales, comentando las diferentes regulaciones acerca del teletrabajo que han existido hasta llegar a la Ley 28/2022, de fomento del ecosistema de las empresas emergentes, donde se pondrá especial atención. Se hará un estudio de la ley, de las implicaciones que conlleva y de cuanto afecta a la movilización de nómadas digitales hacia España, en concreto a Málaga. También se hará una serie de entrevistas con nómadas digitales, los cuales compartirán sus experiencias y opiniones y estas ayudarán a tener otra visión acerca de la propia regulación y de que cosas faltan por mejorar. Finalmente se incluirán sugerencias y se propondrá reformas realistas y realizables que podrían ayudar a perfeccionar la ley con la que se pretende fomentar el aumento de nómadas digitales.

This Final Degree Project aims to study the current regulation of teleworking in general and digital nomads in particular, as well as to analyze the social reasons that are influencing the decisions of nomads when choosing a destination to carry out their professional activity. In this way, it will be possible to better understand this new labor paradigm that is growing by leaps and bounds. And the fact is that, between the increase in teleworking caused by the recent health crises, the emergence of more and more new jobs related to technologies, the ease that exists today to travel to all countries of the world and increasingly comfortable accessibility to get visas or residence permits to live in different countries, make significantly more people join this new way of living. First we will talk about the definitions of teleworking and digital nomads and then we will start with the legal regime that regulates digital nomads, commenting on the different regulations about teleworking that have existed until reaching the Law 28/2022, promoting the ecosystem of emerging companies, where special attention will be paid. There will be a study of the law, the implications it entails and how it affects the mobilization of digital nomads to Spain, specifically to Malaga. There will also be a series of interviews with digital nomads, who will share their experiences and opinions and these will help to have another vision about the regulation itself and what things need to be improved. Finally, suggestions will be included and realistic and achievable reforms will be proposed that could help to improve the law that is intended to encourage the increase of digital nomads
