La cuestión de legitimidad de Gibraltar: un análisis jurídico y político desde la perspectiva del Derecho Internacional

Abstract

La cesión de Gibraltar a Reino Unido por parte de España tras el fin de la Guerra de Sucesión Española en el año 1713 ha suscitado una enorme controversia internacional desde prácticamente el comienzo. A pesar de los esfuerzos por parte de; Naciones Unidas, la Unión Europea y los gobiernos de España, Reino Unido y Gibraltar no se ha podido alcanzar una solución.

Este trabajo de fin de grado comienza analizando los antecedentes históricos y políticos y cuáles han sido los avances y las fases en las relaciones y procesos de negociación bilaterales entre España y Reino Unido, con el fin de alcanzar una propuesta de soberanía en torno al peñón. Este trabajo analiza las propuestas de cosoberanía que se han desarrollado previas al brexit, pero sobre todo se centra en el nuevo marco de negociaciones tras la salida de Reino Unido de la Unión Europea.

El objetivo de este trabajo es determinar la viabilidad jurídica del desarrollo de una posible propuesta de soberanía compartida entre Reino Unido y España tras la salida de este último de la Unión Europea. Asimismo, se tienen en cuenta cuáles son las históricas y permanentes “líneas rojas” que parecen impedir el desarrollo efectivo de cualquier propuesta.

The cession of Gibraltar to the United Kingdom by Spain after the end of the War of the Spanish Succession in 1713 has been the subject of enormous international controversy from almost the outset. Despite the efforts of the United Nations, the European Union and the governments of Spain, the United Kingdom and Gibraltar, a solution has not been reached.

This thesis begins by analyzing the historical and political background and the progress and stages in the bilateral relations and negotiation processes between Spain and the United Kingdom, with the aim of reaching a proposal for sovereignty over the Rock. This paper analyses the co-sovereignty proposals that have been developed prior to Brexit, but above all it focuses on the new negotiation framework following the UK's exit from the European Union.

The aim of this paper is to determine the legal viability of the development of a possible proposal for shared sovereignty between the United Kingdom and Spain following the latter's exit from the European Union. It also takes into account the historical and permanent ‘red lines’ that seem to prevent the effective development of any proposal.
