Resumen
Gibraltar es una colonia británica situada en territorio español. Esto provoca una controversia por la atribución de su soberanía territorial, y esta pugna se traslada y se interrelaciona con la jurisdicción de las aguas que la rodean. España y Reino Unido sostienen posturas divergentes con respecto a los espacios marítimos de Gibraltar. España, sustentándose en la Teoría de la Costa seca, no admite la posibilidad de aguas territoriales que rodeen Gibraltar, aceptando únicamente las aguas reconocidas en el tratado de Utrecht como las aguas del puerto. Reino Unido manifiesta que si un Estado posee derechos sobre un territorio, también los ejerce de la misma manera sobre sus aguas, por ser inherentes a la soberanía territorial. No obstante, el principal argumento de España es que Gibraltar es un territorio pendiente de descolonización, tal y como lo ha catalogado Naciones Unidas y acogiéndose a las diversas resoluciones de la Asamblea General, solicita a Reino Unido la devolución de todos los territorios. Mientras no se produzca la descolonización, es necesario llevar a cabo acuerdos de cooperación como se intentó con el Foro de Diálogo, y tras el Brexit, urge llegar a acuerdos para conseguir una zona de prosperidad compartida por el bienestar de los habitantes de la zona y así conseguir con la previa aceptación de España, un acuerdo futuro entre Unión Europea y Reino Unido. However, Spain's main argument is that Gibraltar is a territory pending decolonisation, as the United Nations has classified it, and in accordance with the various resolutions of the General Assembly, it is asking the UK to return all the territories. Until decolonisation takes place, it is necessary to carry out cooperation agreements, as was attempted with the Dialogue Forum, and after Brexit, it is urgent to reach agreements to achieve a zone of shared prosperity for the well-being of the inhabitants of the area and thus achieve, with the prior acceptance of Spain, a future agreement between the European Union and the United Kingdom.
