Pax Moot Court 2024

Abstract

Este trabajo está enfocado en el caso presentado al 2024 PAX Moot Court competición, llamada turno de Petar Šarčević, por estar dedicado al famoso científico y diplomático serbio del fin del siglo 20. La competición tendrá lugar en Ljubljana, Eslovenia, del 24 al 26 de abril de 2024. Este caso trata de cuestiones diversas sobre la competencia internacional del tribunal de distrito de Ljubljana, donde todos demandantes han presentado su demanda, y sobre la ley aplicable a situaciones implicando temas diferentes: derechos de privacidad y derecho personales en general, retirada de publicaciones en línea, relaciones contractuales, y validez o terminación de un contrato firmado por un menor de edad. Este trabajo contestará a cinco preguntas sobre la competencia judicial internacional y la ley aplicable a cada demanda, y representando cada parte. Por consiguiente, este trabajo se dividirá entre dos partes principales: las conclusiones del demandante, y las del/de los demandado(s), utilizando instrumentos internacionales y europeos, y, en su caso, refiriéndose al derecho nacional, además de recursos jurisprudenciales, doctrinales, y de internet. Veremos que según la parte que se está representando, la interpretación de los hechos y la aplicación de las normas puede ser muy diferente de un memorándum a otro, y es precisamente el interés de este trabajo.

The present essay will focus on the case presented to the 2024 PAX Moot Court Competition called Petar Šarčević Round, for being dedicated to the famous Serbian scientist and diplomat of the end of 20th century of the same name, that will take place in Ljubljana, Slovenia from 24 to 26 April 2024. This case deals with diverse questions on international jurisdiction of the District Court of Ljubljana, where all the disputes are taking place for having been sued by all claimants, and on the law applicable to situations involving different matters such as rights to privacy and personal rights in general, removal of online publications, contractual relationships, and the validity or termination of a contract signed by a minor. This essay will answer to five questions about the jurisdiction and the law applicable to each claim, and on behalf of each party. Therefore, this essay will be composed by two main parts: the conclusions of the Claimant, and the conclusions of the Defendant(s), by using international and European instruments, and where appropriate, by referring to national law, jurisprudence, doctrine, and internet resources. We will see that depending on which party we are representing, the interpretation of the facts and the applicable of the law can be completely different from one memorandum to the other, which is precisely the interest of this essay.
