Protección del menor infractor: garantías y derechos inherentes a la justicia juvenil

Abstract

El presente trabajo aborda la protección del menor infractor y los derechos inherentes a la justicia juvenil. Comienza destacando las características específicas del menor infractor, que son personas en desarrollo que requieren de unas necesidades específicas. Para ello, se establecen una serie de principios que son exclusivos de la justicia juvenil, como por ejemplo el del interés superior del menor. Todos esos principios inherentes a la justicia de menores están recogidos en una serie de instrumentos internacionales, que se revisan de manera pormenorizada a lo largo del trabajo; pasando a analizar después el ajuste del sistema español a dichos estándares y principios.

This chapter addresses the protection of juvenile offenders and the rights inherent in youth justice. It begins by highlighting the specific characteristics of juvenile offenders, who are developing individuals with specific needs. In order for the youth justice system to meet those needs, there are a series of principles that are exclusive to juvenile justice, such as the best interest of the child. All these principles inherent to juvenile justice are included in a series of international instruments, which are reviewed in detail throughout the chapter, followed by an analysis of the adjustment of the Spanish system to these standards and principles.
