El efecto directo horizontal y la responsabilidad del Estado en un caso de crédito al consumo

Abstract

Se analiza el llamado efecto directo que pueden desplegar las Directivas comunitarias y el estado de la jurisprudencia del TJUE en esta materia. En particular se discute sobre el alcance y límites de dicho efecto directo en su vertiente horizontal, es decir, en las relaciones entre privados y en concreto en el caso de la Directiva de crédito al consumo y las consecuencias que para el ciudadano tiene la limitación a este efecto impuesta por el TJUE, abriéndole la vía al cauce de la responsabilidad del Estado por el incumplimiento del Derecho comunitario.

The so-called direct effect that European Community Directives can have and the state of the CJEU jurisprudence on this matter are analyzed. In particular, it discusses the scope and limits of said direct effect in its horizontal aspect, that is, in the relationships between private parties and specifically in the case of the Consumer Credit Directive and the consequences that the limitation to this effect imposed by the CJEU, opening the way to the State's responsibility for non-compliance with Community law.
