Autodeterminación y autonomía de la voluntad, consideraciones iusfilosóficas sobre la libertad y la reducción de su conceptualización

Abstract

El presente artículo quiere ser manifestación de diversas reflexiones que desde el ámbito de la Filosofía del Derecho pueden realizarse respecto a nociones clave para el pensamiento jurídico, ya sea en el Derecho privado, principalmente el civil, como en el político, por ejemplo, para ello se procura conceptualizar y diferenciar términos tales como la libertad, la autodeterminación y la autonomía. Se estima que el primero de ellos se encuentra a partir de la modernidad bastante implícito en la autonomía y para ello se ha querido procurar entenderlo en base a la elección y la autodeterminación ya que al confundirse pierde sustantividad en relación con el lugar clave que ocupa para entender la riqueza del concepto de persona.

This article aims to be a manifestation of various reflections that can be realized from the field of the Philosophy of Law regarding key notions for legal thought, whether in private law, mainly civil law, as in the political, for example, To this end, it seeks to conceptualize and differentiate terms such as freedom, self-determination and autonomy.
