Esta monografía pretende dar una respuesta jurídica a los principales
aspectos controvertidos que presenta el delito de defraudación tributaria. Sin duda, nos hallamos ante uno de los tipos más debatidos del
Código Penal, puesto que en él han surgido discrepancias entre los distintos autores en la mayoría de sus elementos constitutivos y configuradores. A nadie se le escapa que una de las mayores dificultades viene dada
por su interpretación armónica con la normativa tributaria, así como por
las relaciones que pueden surgir entre los órdenes jurisdiccionales
contencioso-administrativo y penal, lo que dificulta su comprensión.
El delito analizado presenta una redacción farragosa, con preceptos de
una extensión desmesurada, lo que complica la labor del intérprete. En la
doctrina se ha discutido prácticamente la totalidad de su regulación,
tanto el tipo objetivo como el tipo subjetivo, y ello tiene sus consecuencias en la práctica judicial. Puesto que estamos ante una de las figuras
delictivas de mayor interés mediático, y en la que habitualmente surgen
dudas interpretativas, este libro pretende explicar sus elementos estructurales esenciales, para lo que se exponen las principales corrientes

motivada jurídicamente. La finalidad perseguida es, por lo tanto, poner de
