| dc.description.abstract | El Tribunal de Justicia de la Unión Europea se enfrenta a una cuestión sobre contratos de crédito al consumo. La Directiva 2008/48/CE impone al prestamista la obligación de evaluar la solvencia del consumidor, y el tribunal de remisión alberga dudas sobre las sanciones establecidas en Derecho francés en caso de incumplimiento de esta obligación. Las sanciones podrían no ser efectivas, proporcionadas y disuasorias, lo cual es un requisito dispuesto por la Directiva. | es-ES |
