El lingüista forense: concepto, perfil y aportación procesal de este perito

Abstract

Esta investigación trata, desde la óptica del Derecho, la figura y el trabajo, en los procesos judiciales, del lingüista forense, un desconocido para la mayoría de los juristas, tal y como se deduce del escaso tratamiento existente en textos jurídicos generales y especializados. Se parte de la exposición de conceptos, igualmente poco o nada frecuentados por la literatura jurídica, que nacen en la lingüística forense y que resultan necesarios para entender sus tareas y diversas aportaciones a los procesos. Por ello, tras una breve presentación conceptual, se exponen las áreas de trabajo del lingüista forense y la necesidad de una formación específica. Finaliza el artículo con el recorrido por las posibles actuaciones que puede realizar este perito a lo largo del proceso civil español, al resultar este proceso subsidiario del resto de jurisdicciones. Para tratar estos aspectos, se ha revisado la literatura científica de esta especialidad y diversos supuestos prácticos en los que el trabajo de este experto ha resultado decisivo para esclarecer los hechos en distintos procesos. La última conclusión extraíble es que el trabajo del perito lingüista forense, pese a ser desconocido, puede constituir una prueba muy adecuada y provechosa en su ámbito de especialización.

This research deals, from a legal perspective, with the figure and work of the forensic linguist in judicial proceedings, an unknown for most jurists, as can be deduced from the scarce treatment existing in general and specialized legal texts. It is based on the exposition of concepts, that are equally little or not at all frequented by the legal literature, which are born in forensic linguistics, and which are necessary to understand their tasks and diverse contributions to the processes. Therefore, after a brief conceptual approach, the areas of work of the forensic linguist and the need for specific training are presented. The article ends with a review of the possible actions that this expert can carry out throughout the Spanish civil process, as this process is subsidiary to the rest of the jurisdictions. To deal with these aspects, the scientific literature of this specialty has been reviewed, as well as several practical cases in which the work of this expert has been decisive in clarifying the facts in different proceedings. The last conclusion to be reached is that the expertise of the forensic linguist, although unknown, can constitute very adequate and useful evidence in his or her specific area of expertise.
