El forum necessitatis en el derecho internacional privado europeo

Abstract

En este trabajo se aborda la figura del forum necessitatis como instrumento jurídico del derecho internacional privado. Se estudia su importancia en el derecho europeo actual, así como su fundamento, la tutela judicial efectiva como derecho fundamental protegido por esta figura. Se analizan también las distintas fuentes normativas reguladoras del forum necessitatis tanto a nivel nacional de distintos Estados Miembros como a nivel de la Unión Europea. Por último, se evalúa el impacto práctico de esta figura y sus posibles desafíos y ventajas analizando su posible incorporación en futuras reformas legislativas.

This paper deals with the concept of forum necessitatis as a legal mechansim within private international law. It explores its contexts and significance in current European law, as well as its legal foundation, effective judicial protection as a fundamental right safeguarded by this mechanism. The study also analyzes the various regulatory sources governing forum necessitatis, both at the national level of different Member States and the European Union level. Finally, it evaluates the practical impact of this concept, alongside its possible challenges and advantages, assessing the potential for legislative reform.
