EL IMPACTO DE LA JUSTICIA RESTAURATIVA EN LOS PROTAGONISTAS DEL SISTEMA PENAL: LA TRANSFORMACIÓN DE LAS PERSONAS PENADAS Y DE LAS VÍCTIMAS

Abstract

En el presente trabajo de fin de grado se ha tratado de analizar el impacto de justicia restaurativa en las víctimas y los infractores que participan en procesos de este tipo. Por ello, se ha perseguido el objetivo de estudiar los efectos que los procesos restaurativos han tenido en ambas partes, prestando especial atención a los aspectos emocionales, psicológicos y sociales que se derivan de tales procedimientos. Para ello, se ha llevado a cabo una revisión bibliográfica de diferentes informes y se han analizado, concretamente, tres estudios relevantes en la materia: dos de ellos llevados a cabo en nuestro país, específicamente en el País Vasco y otro elaborado por el Foro Europeo de Justicia Restaurativa, el cual recoge datos de Austria, Países Bajos y Finlandia. A partir de la revisión y el análisis de sus resultados, se ha podido observar cómo el impacto, en la mayoría de los casos, fue positivo para sus participantes. De este modo, se observan unos hallazgos principalmente relacionados con cambios y mejoras emocionales por parte de las víctimas y mayor asunción de la responsabilidad y compromiso de reparación por parte de los ofensores. Estos resultados ayudan a reconocer y poner en valor la eficacia y el impacto que las medidas restaurativas pueden llegar a tener en sus protagonistas, así como el potencial transformador y la mirada humana que aportan al proceso penal.

This final degree project aims to analyze the impact of restorative justice on victims and offenders who participate in such processes. The main objective has been to study the effects that restorative procedures have had on both participants, with particular attention to the emotional, psychological, and social aspects derived from these experiences. To achieve this, a literature review was conducted, focusing specifically on three relevant studies in the field: two carried out in Spain, specifically in the Basque Country, and another developed by the European Forum for Restorative Justice, which includes data from Austria, The Netherlands, and Finland. From the review and analysis of their results, it was observed that the impact was, in most cases, positive for both participants. The findings mainly reveal emotional improvements and positive changes in victims, as well as better acknowledgment of responsibility and commitment to reparation among offenders. These results help to highlight and value the effectiveness and impact that restorative measures can have on those involved, as well as the transformative potential and human-centered approach that they bring to criminal justice proceedings.
