LA PROTECCIÓN JURIDICA DE LOS MENORES EN SITUACION DE VULNERABILIDAD

Abstract

El presente trabajo analiza diversas situaciones de vulnerabilidad en las que un menor de edad puede encontrarse. Este colectivo es actualmente uno de los grupos que más atención requiere debido a los diversos conflictos que enfrenta a nivel social, educativo y familiar. A fin de garantizar una protección adecuada, será necesario atender a las circunstancias y necesidades específicas de cada menor, lo que permitirá determinar las medidas de tutela más apropiadas a su situación particular. Asimismo, será objeto de estudio el marco normativo vigente en el ordenamiento jurídico español y europeo destinado a garantizar la adecuada protección de los menores, con especial énfasis en la evolución legislativa que ha tenido lugar a lo largo del tiempo. En tercer término, se examinarán ámbitos específicos en los que los menores puedan encontrarse en situación de desamparo, con el propósito de identificar y proponer medidas idóneas para su adecuada protección.

This paper analyzes various situations of vulnerability in which a minor may find himself/herself. This group is currently one of the groups that requires the most attention due to the various conflicts it faces at the social, educational and family levels. In order to guarantee adequate protection, it will be necessary to take into account the specific circumstances and needs of each minor, which will make it possible to determine the most appropriate guardianship measures for his or her particular situation. Likewise, the regulatory framework in force in the Spanish and European legal system aimed at guaranteeing the adequate protection of minors will be studied, with special emphasis on the legislative evolution that has taken place over time. Thirdly, specific areas in which minors may find themselves in a situation of neglect will be examined, with the purpose of identifying and proposing suitable measures for their adequate protection.
