Abstract

Este estudio analiza si se puede alcanzar la pacificación del País Vasco después del terrorismo de ETA únicamente mediante un enfoque sancionador o si es imprescindible enriquecer la justicia penal con mecanismos de justicia transicional. Mediante un análisis de la bibliografía, se examina el efecto del terrorismo, la reacción del Gobierno Vasco y las acciones puestas en marcha en memoria, reparación y justicia a fin de obtener una pacificación social. Los hallazgos señalan que, pese a ser esencial para prevenir la impunidad, la justicia punitiva no ha sido suficiente para alcanzar una coexistencia pacífica. La justicia transicional ha facilitado la identificación de las víctimas y el restablecimiento de la memoria histórica, sin embargo, su implementación ha suscitado discusiones y resistencias en ciertos grupos.

This study examines whether the pacification of the Basque Country after ETA's terrorism can be achieved solely through a punitive approach or if transitional justice mechanisms are necessary. Through a literature review, the research analyzes the impact of terrorism, the response of the Basque Government, and the measures implemented in memory, reparation, and justice to reach a social pacification. The findings indicate that while punitive justice is essential to prevent impunity, it has not been sufficient to achieve peaceful coexistence. Transitional justice has contributed to recognizing victims and recovering historical memory, but its implementation has sparked debates and resistance in some sectors.
