Responsabilidad social de la abogacía.

Abstract

Este Trabajo de Fin de Grado aborda la Responsabilidad Social de la Abogacía (RSA) como una dimensión esencial del ejercicio profesional del abogado en el contexto jurídico español. Partiendo de un enfoque integral, se analiza la evolución del concepto, sus fundamentos éticos, deontológicos y filosóficos, y su vinculación con la función social que históricamente ha caracterizado a la abogacía. Se pone de relieve cómo la RSA va más allá de la defensa técnica de los intereses del cliente, para convertirse en un compromiso activo con la justicia, la equidad y la cohesión social.

A nivel normativo, se examinan los principales instrumentos que regulan el ejercicio profesional: el Código Deontológico, el Estatuto General de la Abogacía Española, la Ley Orgánica del Derecho de Defensa y la Ley de Asistencia Jurídica Gratuita. Estos textos no solo definen los deberes éticos y jurídicos de los abogados, sino que también refuerzan el papel de los Colegios de la Abogacía como garantes de la calidad, independencia y transparencia de la profesión.

El trabajo incluye también un estudio de experiencias pro bono con alto impacto social, impulsadas por fundaciones, clínicas jurídicas universitarias y despachos de abogados, que evidencian el potencial transformador de la RSA cuando se traduce en acciones concretas. Por último, se analiza el impacto de la inteligencia artificial en el ámbito legal y su influencia en la transformación de la profesión, planteando tanto oportunidades como desafíos éticos y regulatorios.

A través de este análisis, el trabajo contribuye a una comprensión crítica y actualizada de la RSA como herramienta indispensable para reforzar la legitimidad del Derecho y el compromiso social de la abogacía en el siglo XXI.

This Bachelor’s Thesis explores the concept of the Social Responsibility of the Legal Profession (SRLP) as an essential dimension of legal practice within the Spanish legal framework. Adopting a comprehensive approach, it analyzes the evolution of the concept, its ethical, deontological, and philosophical foundations, and its connection to the social function that has historically characterized the legal profession. The study emphasizes that SRLP goes beyond the technical defense of clients’ interests to become an active commitment to justice, equity, and social cohesion.

On a regulatory level, the main instruments governing professional legal practice are examined: the Code of Ethics, the General Statute of the Spanish Legal Profession, the Organic Law on the Right of Defense, and the Law on Legal Aid. These texts not only define the ethical and legal duties of lawyers but also reinforce the role of Bar Associations as guarantors of the profession’s quality, independence, and transparency.

The thesis also includes an analysis of high-impact pro bono initiatives promoted by foundations, university legal clinics, and law firms, which demonstrate the transformative potential of SRLP when translated into concrete actions. Lastly, it assesses the impact of artificial intelligence on the legal field and its influence on the transformation of the profession, highlighting both opportunities and ethical and regulatory challenges.

Through this analysis, the thesis offers a critical and updated understanding of SRLP as an indispensable tool to strengthen the legitimacy of the legal system and the social commitment of the legal profession in the 21st century.
