Menor y Violencia de género: ¿sujeto pasivo de esa violencia?

Abstract

La violencia de género, si bien ha estado presente a lo largo de la historia, en los últimos años, ha sido objeto de agendas políticas, reformas legislativas y numerosos estudios psicológicos y sociales. Estos estudios se han centrado, básicamente, en analizar las consecuencias físicas y psicológicas que esta violencia tiene sobre las mujeres, con el objetivo de desarrollar medidas de prevención y mecanismos de protección enfocados en las mujeres como sujeto pasivo de este delito. No obstante, es fundamental tener en cuenta las posibles consecuencias que la violencia de género puede tener sobre los menores, hijos e hijas, que conviven y se desarrollan en un contexto caracterizado por conductas violentas dirigidas hacia sus madres. En este sentido, es preciso mencionar que la violencia de género puede afectar de forma negativa al desarrollo y bienestar psicológico y la integración en la sociedad del menor. Por ello, resulta necesario analizar la evolución de las leyes que han regulado la violencia de género y las reformas legales que han introducido la figura del menor como víctima directa, pues en ellas se refleja el cambio en la consideración del menor, quien comienza siendo invisible frente a la violencia de género hasta ser reconocido como víctima directa de esta violencia.

Although gender-based violence has been present throughout history, in recent years it has been the subject of political agendas, legislative reforms and numerous psychological and social studies. These studies have mainly focused on analyzing the physical and psychological consequences that this violence has on women, with the aim of developing prevention measures and protection mechanisms focused on women as passive subjects of this crime. However, it is essential to take into account the possible consequences that gender violence can have on minors, sons and daughters, who live and develop in a context characterized by violent behavior directed against their mothers. In this sense, it should be mentioned that gender-based violence can negatively affect the child's development, psychological well-being and integration into society. Therefore, it is necessary to analyze the evolution of the laws that have regulated gender violence and the legal reforms that have introduced the figure of the minor as a direct victim, as they reflect the change in the consideration of the minor, who is initially invisible in the face of gender violence, until he or she is recognized as a direct victim of this violence.
