El Gobierno (Tema 7)

Abstract

El concepto de Gobierno en España ha evolucionado a lo largo de su historia constitucional. Las primeras constituciones no contemplaban una regulación clara del Gobierno, centrando el poder ejecutivo en el Rey. Con la Constitución de 1978, se establece una regulación sistemática, diferenciando las funciones del Gobierno de las del Rey como Jefe de Estado. El Gobierno se organiza en torno al Presidente, cuya elección se realiza a través del Congreso de los Diputados. Además, el Presidente tiene un papel preeminente en la formación del Gobierno, la dirección de la política y la coordinación de sus miembros. El Gobierno cesa en situaciones como la celebración de elecciones, pérdida de confianza, dimisión o fallecimiento del Presidente. Asimismo, el Gobierno en funciones se limita a tareas de gestión ordinaria, con restricciones en la adopción de decisiones importantes.

The concept of Government in Spain has evolved throughout its constitutional history. The first constitutions did not contemplate a clear regulation of the Government, focusing the executive power on the King. With the 1978 Constitution, a systematic regulation was established, differentiating the functions of the Government from those of the King as Head of State. The Government is organized around the President, whose election is carried out through the Congress of Deputies. In addition, the President has a pre-eminent role in the formation of the Government, the direction of policy and the coordination of its members. The Government ceases in situations such as elections, loss of confidence, resignation or death of the President. Likewise, the acting Government is limited to ordinary management tasks, with restrictions on the adoption of important decisions.
