La abogacía como profesión garante del derecho fundamental a la justicia

Abstract

A tenor del artículo 24 CE toda persona tiene derecho a un juez imparcial, a un proceso justo y a la asistencia de letrado, incluso de manera gratuita si estuviese justificado. A la luz del artículo citado, en este capítulo se proclama la necesaria vinculación entre la profesión de la abogacía y el derecho fundamental a la tutela judicial y no indefensión o derecho a la justicia. Con ese propósito se revisan críticamente aquellos ámbitos jurídicos en los que dicha relación se da plenamente y aquellos otros en los que puede ponerse en riesgo. De ahí la importancia de una formación sólida en la profesión de la abogacía no solo en los aspectos técnicos del Derecho, sino en todo lo relacionado con el servicio público, el respeto a las instituciones democráticas, al Estado de Derecho y los derechos fundamentales de los justiciables y defendidos.

According to Article 24 of the Spanish Constitution, every person has the right to an impartial judge, a fair trial, and legal assistance, even free of charge if justified. In light of the cited article, this chapter proclaims the necessary link between the legal profession and the fundamental right to judicial protection and not being left defenseless or the right to justice. With this purpose, it critically reviews those legal areas where this relationship is fully realized and those where it may be at risk. Hence, the importance of solid training in the legal profession, not only in the technical aspects of law but also in everything related to public service, respect for democratic institutions, the rule of law, and the fundamental rights of those seeking justice and those being defended.
