The Evolution of the Notion of Product in EU Product Liability Law, en Modern Problems of Liability in Civil Law

Abstract

La Directiva 85/374/CEE fue un texto histórico para la normativa sobre responsabilidad por productos defectuosos en la Unión Europea. Sin embargo, el entorno socioeconómico, la legislación sobre seguridad, y la propia tecnología han evolucionado desde 1985. Así pues, existía un consenso general sobre la necesidad de adaptar la legislación de la UE en materia de responsabilidad por productos para afrontar el progresivo paso de bienes tangibles a activos digitales. En octubre de 2024 se aprobó la Directiva 2024/2853, que deroga la antigua con efectos a partir del 9 de diciembre de 2026. ¿Cómo ha evolucionado y ha sido definida exactamente la noción de «producto» en la Directiva 2024/2853? Directive 85/374/EEC was a landmark text for product liability law in the European Union. However, the socio-economic environment, legislation on safety, or technology itself, have all of them evolved since 1985. Thus, there was a general consensus that EU product liability law should be adapted to address the trend from (tangible) goods to digital assets. In October 2024, Directive 2024/2853 was approved, repealing the ancient one with effect from 9 December 2026. How exactly the notion of “product” has evolved and been defined in Directive 2024/2853? An exhaustive analysis cannot be made in just a few pages. Consequently, this contribution must remain humble in its purpose and will try to outline only basic insights on the matter.
