Hygiene and public health as a concretion of utillitas publica in the urban environments in Rome

Abstract

.No podemos negar la preocupación de los romanos por regular diferentes manifestaciones del medio ambiente en el contexto urbano que afectaban a la vida cotidiana de los ciudadanos, como aquellas normas referidas al enterramiento o incineración de cadáveres dentro de la ciudad o la regulación de los baños o termas, que requerían un correcto abastecimiento de recursos hídricos, entre otros ejemplos. Para entender todo este entramado jurídico de protección del medio ambiente dentro de las ciudades, es necesario centrarse en el concepto de salubritas, que hace referencia a las condiciones de higiene y salud pública necesarias para el correcto desarrollo humano de los habitantes de las ciudades. En este sentido, se puede afirmar de forma concluyente que la salubritas publica, en nuestra opinión, debe ser considerada como una concreción particular de la noción general de utillitas publica.

We cannot deny the concern of the Romans in regulating different manifestations ofthe environment in the urban context that affected the daily life ofthe citizens, such as those rules referring to the burial or cremation of corpses within the city or the regulation of the baths or thermal baths, which required a correct supply of water resources, among other examples. In order to understand this whole legal framework of environmental protection within cities, it is necessary to focus on the concept of salubritas, which refers to the conditions of hygiene and public health necessary for the proper human development of the inhabitants of cities. In this sense, it can be stated conclusively that salubritas publica, in our opinion, should be considerad as a particular concretisation of the general notion of utillitas publica.
