La supresión de la Inquisición en las Cortes de Cádiz
Resumen
La Inquisición Española fue una institución clave que condicionó a España durante 300 años. En el siguiente estudio, el cual no se centra en la andadura del Santo Oficio aunque la explica brevemente, analizaremos de forma sucinta los detalles de sus antecedentes y orígenes, así como los pormenores de su forma de proceder: el procedimiento inquisitorial. Analizaremos también los intentos de Napoleón para abolirla mediante el Decreto de Chamartín, pero sobre todo nos centraremos en estudiar su primera abolición, que tuvo lugar en las Cortes de Cádiz, y la alternativa que propuso esta Asamblea Constituyente al Tribunal de la Inquisición: los Tribunales protectores de la Fe.
Expondremos y analizaremos el debate parlamentario que tuvo lugar entre diciembre de 1812 y enero de 1813 sobre la Inquisición, su encaje en la Constitución de 1812 y su futuro en el proyecto de la nueva España liberal que iba a nacer en Cádiz y que se vio truncado con la vuelta al absolutismo de mano de Fernando VII, así como el diverso tratamiento que recibió el Santo Oficio por parte del Rey, según su conveniencia y la oportunidad política del cada momento, en las diversas etapas de su reinado. Todo ello para finalmente llegar a la definitiva abolición de la Inquisición Española, ya muerto Fernando VII, en el año 1834. Spanish Inquisition was a main institution that conditoned Spain during 300 years. In the following study, will be studied briefly the details of the origin, and background of ehis institution, furthermore the details of the Inquisitoiral procedure. We will analyze Napoleon’s attempts to abolish it in the “Decreto de Cahamrtín”. This study is focused on the first abolition of the Spanish Inquisition in the “Cortes de Cádiz”, and the alternative proposed by this constitutent assembly to the Inquisition: The “Tribunales protectores de la Fe”.
We will present and analyze the parilamentary debate that take place Between December 1812 and January 1813 about the Inquisition, their insertion in the Spanish Constitution of 1812 and the future of the institution in the project of the modern Spain borned with the new Constitution, project that fail with the return to the absolutism of the King Fernando VII. We will also analyze the diferent treatment that the King Fernando gives to the Inquisition depending on the convenience of the moment in the different stages of his reing. We will end the study with the analysis of the definitive abolition of the inquisition after King Fernando’s death in 1834.
