Disolución pontificia del matrimonio no consumado. Praxis canónica y eficacia civil en España:

Abstract

Además de las nulidades matrimoniales, existen otros remedios canónicos ante las rupturas conyugales, entre los que se encuentra la posibilidad de disolución pontificia del matrimonio, en el supuesto de que no haya sido consumado. El Papa, tras un procedimiento tramitado en las diócesis y resuelto en Roma, puede disolver en estos casos el vínculo matrimonial, permitiendo a las partes contraer nuevo matrimonio canónico. Esta disolución pontificia puede, además, alcanzar eficacia civil en España, previo reconocimiento por el juez estatal. Pese a esta relevancia eclesial y jurídica, tanto en el ámbito canónico como en el mismo derecho español, se trata de de resoluciones canónicas frecuentemente desconocidas, en parte debido a su propia configuración jurídica, a su falta de publicación de las mismas, a la escasa motivación jurídica de estas decisiones, etc. En este libro, se expone de modo completo y actualizado la normativa y doctrina canónica, y se analizan más de un centenar de causas de disolución canónica tramitadas en diócesis españolas, lo que permite profundizar en la diversidad de supuestos fácticos de no consumación del matrimonio, en los criterios de la Santa Sede en la resolución de los mismos, así como en algunas peculiaridades procesales en la tramitación de estos procedimientos. Asimismo, el libro expone el régimen civil español de reconocimiento de estas decisiones canónicas, profundizando en aquellas cuestiones sustantivas y procesales susceptibles de provocar divergencias doctrinales y jurisprudenciales.

PONTIFICAL DISSOLUTION OF THE NON-CONSUMMATED MARRIAGE. CANONICAL PRAXIS AND CIVIL EFFECTS IN SPAIN

Canonical dissolution of non-consummated marriages appears as a misused remedy in the treatment of the marriage situations of the faithful. However, this canonical dissolutions are, in general, quite unknown within the activity of the ecclesiastical courts in matrimonial matters. They are resolutions whose access and study is not easy, since the Pontifical rescripts granting the dissolution of the marriage are not published, neither the responses of the Apostolic See rejecting these petitions. They are synthetic resolutions, devoid of legal motivation, quite different from judicial judgments. This requires to analyse the acts of the case in order to deduce in which facts and legal foundations resolutions are based. This research aims to fill this gap, providing an approach to the procedures of dissolution, so that it would be possible to know which cases of canonical dissolution for non-consummated marriage were introduced by the Spanish faithful, and how these cases were handled, including the answer they received from the Holy See. With this purpose, 112 dissolution procedures of non-consummated canonical marriages, followed in the Spanish dioceses, have been compiled. The number of resolutions and the variety of situations contained in them give a fairly broad view of the diverse cases that arise in these causes and the criteria of the Congregation for their resolution.

Particular attention is paid to substantive and procedural issues that may have relevance towards a possible recognition of these canonical resolutions in the civil legal field, prior approval given by the State judge. The book presents the Spanish regime on civil effect of Pontifical rescripts over non consummated marriages, from a procedural and substantive perspective, focusing on legislation and the both doctrinal and jurisprudence interpretation given over some aspects which remain not clear, with special attention to the resolutions of the Supreme Court in this matter.
