La intersección Psicoanálisis y Derecho como puente sobre aguas turbulentas

Abstract

¿Cómo pueden relacionarse el Psicoanálisis y el Derecho? Dos instancias que, decididamente, pueden encontrarse, o desencontrarse: el Psicoanálisis con el Derecho, como camino de ida, y el Derecho con el Psicoanálisis, como camino de vuelta. O viceversa. No se sabe bien si el puente entre ambas instancias permitirá avanzar en un sentido o, dicho de otra forma, si lo que acontecerá será una regresión en el sentido ya trazado. No sabiendo, por tanto, si, finalmente, se logrará avanzar y/o regresar, por eso, precisamente por eso, porque no se sabe todavía a qué atenerse, tiene que acometerse una tentativa: que bien podrá fraguarse como encuentro o desencuentro interdisciplinar. Nos interesará, pues, poner el acento en la conjunción copulativa que hace las veces de puente entre dos escenografías: la del diván que, inconscientemente, cabalga a lomos de la asociación libre; y la de los estrados y las tribunas que, con la pretensión de erigirse en un constructo consciente, tendrá que ordenarse recurriendo a la interpretación. Asistiremos, así, a una doble llamada a la hermenéutica: en un ámbito la clave radicará en los sueños en tanto en cuanto en el otro la tarea interpretativa verá la luz a través de la integración fáctico-jurídica. Sobre la mención final del título a las aguas turbulentas no será oportuno, por el momento, incidir; a no ser para recalcar que, si no fuera por las aguas turbulentas, no habría ninguna necesidad de plantearse la posibilidad de tender puentes. Una posibilidad que convendrá desgranar para tener algo que decir a resultas de la reflexión sobre el diálogo interdisciplinar entre dos instancias como son las que se sitúan en ambos extremos del puente tendido para prestar acogida a la intersección Psicoanálisis y Derecho.

How can Psychoanalysis and Law relate? Two instances that, decidedly, can be found, or disassociated: Psychoanalysis with Law, as a way of going, and Law with Psychoanalysis, as a way back. It is not clear whether the bridge between the two instances will allow us to advance in one direction or, in other words, if what will happen will be a regression in the sense already drawn. Not knowing, therefore, if, finally, it will be possible to advance and / or return, that is why, precisely because, because we do not yet know what to take, an attempt must be made: that it may well be forged as an interdisciplinary encounter or disagreement.

We will therefore be interested in putting the accent on the copulative conjunction that serves as the bridge between two scenographies: that of the divan who, unconsciously, rides on the back of free association; And that of the stands and tribunes which, with the intention of being erected in a conscious construct, will have to be ordered by means of interpretation. We will thus witness a double call to hermeneutics: in one field the key will lie in dreams as long as in the other the interpretive task will see the light through factual-legal integration.

On the final mention of the title to turbulent waters it will not be appropriate, for the moment, to focus; Except to emphasize that if it were not for turbulent waters, there would be no need to consider the possibility of building bridges. A possibility that should be explored to have something to say as a result of the reflection on the interdisciplinary dialogue between two instances such as those that are located at both ends of the bridge designed to accommodate the intersection Psychoanalysis and Law.
