La pornografía infantil como especie de la pornografía en general

Abstract

La determinación del significado del concepto de pornografía resulta esencial para la elaboración de cualquier propuesta político-criminal destinada a reaccionar frente a esta manifestación de la libertad de expresión. Se considera necesario adoptar como punto de partida una definición que permita abarcar todas las manifestaciones del fenómeno y que se encuentre desprovista de valoraciones jurídicas. Se propone un concepto criminológico de pornografía basado en el carácter sexualmente explícito del contenido y en la tendencia a la excitación sexual manifestada en el espectáculo o material. La pornografía infantil, en cuanto que especie dentro del género de la pornografía, ha de reunir dichos elementos caracterizadores, si bien presenta una serie de particularidades que justifican una interpretación más flexible de los mismos.

The determination of the meaning of the concept of pornography is essential for the elaboration of any proposal aimed at reacting to this manifestation of the freedom of speech. It is considered necessary to adopt, as a starting point, a definition devoid of legal valuations, that covers all manifestations of the phenomenon. A criminological concept of pornography is proposed based on two elements: the sexually explicit content and the tendency to sexual excitement manifested in the spectacle or material. Child pornography, as a species within the genre of pornography, must bring together such characterizing elements, although child pornography presents a series of peculiarities that justify a more flexible interpretation of them.
