El embargo preventivo de buques como medida cautelar
Resumen
Este trabajo trata del análisis del embargo preventivo de buques. El embargo preventivo de buques es una de las diferentes medidas cautelares reconocidas en nuestro ordenamiento jurídico. Como toda medida cautelar, es bastante aceptada en la práctica, debido a que dichos recursos, son medios, a veces más eficaces, y otras veces menos, para el aseguramiento del cumplimiento de las pretensiones que el demandante tenga. En definitiva, las medidas cautelares representan una garantía. En sí misma, el embargo preventivo de buques, supone una medida cautelar especial o específica, ya que para su regulación, además del régimen general previsto, habrá que tener en cuenta la legislación nacional específica que dé tratamiento a la medida, así como la normativa internacional al respecto, que es donde verdaderamente se encuentra el grueso de su regulación. Este hecho es así como consecuencia de su importancia internacional, tanto para el tráfico jurídico como para el tráfico marítimo, contando con una gran aceptación por la comunidad internacional respecto a su eficacia. El embargo preventivo de buques, reporta al acreedor de un crédito marítimo varias ventajas procesales, en comparación con el régimen general, y mediante ella, se llevará a cabo de forma rápida la inmovilización sobre el buque que se pretende embargar. En la mayoría de los casos de embargo preventivo de buque, se obtendrá la satisfacción del crédito marítimo alegado a cambio de la liberación del barco trabado. This work treats the analysis of the ship arrest. The ship arrest is one of the different precautionary measures recognized in our legal system. As with any precautionary measure, it is quite acceptable in practice, due to they are remedies, sometimes more effective, and sometimes less, for the assurance of compliance with the claims that the plaintiff has. In short, precautionary measures represent a guarantee. In itself, the ship arrest is a specific or special precautionary measure, as it will be necessary to take into account the specific national legislation which treats this measure, as well as the international regulation, which is where the bulk of the regulation of this measure lies, in addition to the general regime envisaged. This fact is consequence of its international importance both for legal traffic and maritime traffic, with great acceptance by the international community regarding its effectiveness. The ship arrest, reports, to the creditor of a maritime credit, several procedural advantages, compared to the general regime, and through it, will be carried out a quick immobilization of the ship that is intended to arrest. In most cases of ship arrest, the satisfaction of the alleged maritime credit will be obtained in exchange for the release of the arrested ship.
