Los delitos de odio y las redes sociales

Abstract

El objetivo de este trabajo es tener una visión global de los delitos odio analizando el concepto y sus principales características para después poder entender cómo están regulados en el ordenamiento español y por qué se ha optado por proteger determinadas características y colectivos penando un rango más amplio de acciones que las que estaban previstas en el anterior Código Penal. Estos delitos, están teniendo una gran repercusión actualmente debido a las redes sociales ya que aunque hace unos años era impensable que alguien fuera condenado por hacer unas publicaciones expresando sus ideas en una red social, a día de hoy son cada vez más los condenados por este tipo de delitos. Este estudio, nos permitirá también apreciar donde está el límite entre la libertad de expresión y la integridad de la persona viendo no sólo que opina el ordenamiento español sobre esto sino también organismos internacionales.

The main objective of this thesis is to outline the hate crimes, specially the hate speech, analyzing how this crime is regulated in the Spanish law system and why some minorities and collectives are protected. After the last change in the Spanish Criminal Law Code, these crimes are more punished and the situations that can be prosecuted are more than before. Hate speech crimes are having a high repercussion lately because of the increase of the trials due to hate speech comments in social networks. This work will allow us to appreciate the limit between the freedom of speech right and the honor and integrity right seeing what multiple organizations think about these limits.
