El reconocimiento en España de las adopciones constituidas en el extranjero

Abstract

La adopción es una de las figuras más antiguas del derecho de familia, y aunque el objetivo de la institución adoptiva ha ido cambiando a lo largo de la historia, hoy el fin primordial es proteger el interés superior del menor y velar por el respeto de sus derechos. Puntualizando que no podrá existir en ningún caso discriminación entre los hijos adoptivos y los hijos naturales.

En el caso particular de las adopciones constituidas en el extranjero por autoridad extranjera, superadas las fases administrativas en cada uno de los países implicados y tras comprobar la competencia del órgano que constituyo la adopción, la correcta aplicación de la ley, la existencia de toda la documentación pertinente, en especial del certificado de idoneidad de los adoptantes y que en ningún caso la adopción sea contrario al orden público, esta deberá ser reconocida e inscrita en el Registro Civil. Si los estados partes de la adopción son firmantes del Convenio de las Haya de 1993, tal reconocimiento será automático, si no fuese este el caso será el Cónsul Español en el país de origen del menor o el Juez encargado del Registro Civil Central el que comprobará que se cumplen los requisitos para el reconocimiento y la correspondiente inscripción, siendo incluso posible tramitarlo bajo el amparo de un Convenio Bilateral.

El reconocimiento y la posterior inscripción de la adopción es vital para que el menor, que adquiere la nacionalidad española, pueda comenzar su nueva vida con la familia adoptante, pues de esta manera la adopción tendrá plena eficacia jurídica para el ordenamiento español.

Adoption is one of the oldest figures in family law, and eventhough the objective of the adoptive institution has changed throughout history, it can be said that, as pf today, its primary goal is to protect the best interests of the child and ensure respect for childrens rights. It is compulsory to point out that there can be no discrimination between adopted children and natural children.

In the particular case of adoptions constituted abroad by a foreign authority, the administrative phases in each of the countries involved, bearing in mind that the administrative phases have been overcome, and after verifying the competence of the body that constituted the adoption, the correct application of the law, the existence of all the Relevant documentation, especially the certificate of suitability of the adopters and that in any case the adoption is contrary to public order, must be recognized and registered in the Civil Registry. If the states parties to the adoption are signatories of the 1993 Hague Convention, such recognition will be automatic, otherwise the Spanish Consul in the child's country of origin or the Judge in charge of the Central Civil Registry will check that the requirements for recognition and corresponding registration are met, and it is even possible to process it under the protection of a Bilateral Agreement.

The recognition and subsequent registration of the adoption is vital for the child, who acquires Spanish citizenship, to start his or her new life with the adoptive family, as it is the way to ensure that the adoption has full legal effect for the Spanish legal system.
