dc.description.abstract | El objeto de estudio de nuestro trabajo se centra en analizar la viabilidad y legitimidad jurídica que tendría la implantación de una SOCIMI cuyas inversiones girasen en torno a operaciones de Sale and Lease-back con activos inmobiliarios propiedad del Estado. El trabajo comienza haciendo una breve introducción tratando de aproximar la realidad actual a nuestra propuesta. Posteriormente se centra en analizar las implicaciones que tiene en nuestro país la elección del vehículo de inversión SOCIMI analizando los requisitos y particularidades fiscales que presenta el concepto y trazando una evolución legislativa desde que se introdujo la figura en nuestro ordenamiento hasta el día de hoy. Concluye elaborando una comparación con otras figuras jurídicas contempladas en nuestro ordenamiento. La segunda parte del estudio trata de la forma en la que se puede proceder a realizar dichas operaciones con el Estado, centrándose en la ley de Patrimonio de las Administraciones Públicas y observando como es el proceso jurídico que atañe a estas operaciones en los distintos momentos de la operación. | es-ES |
dc.description.abstract | This study, intends to analyze the feasibility of creating a SOCIMI (which is the Spanish equivalent to REIT) that would specialize and focus its investments towards Spanish Government Real Estate assets in order to create a valuable and low-risk asset portfolio. The first part of the study introduces the concept and specialties regarding the particular tax regime that SOCIMIS have regarding also the requisites that must be present in its functioning and trying to obtain an insightful understanding of the advantages that they have when meeting certain requisites within the Spanish tax legal system. It furthermore analyses the procedure of carrying out a sale and lease-back operation with the Spanish government, focusing on the Spanish public real estate assets law and establishing further conclusions about the implications of this operations. | en-GB |
