Regtech y Fintech: perspectivas de política legislativa para las nuevas tecnologías financieras

Abstract

El presente trabajo contribuye a la reflexión sobre la regulación de la industria Fintech a partir de las grandes ideas de la teoría financiera, aportando un marco conceptual que permite entender y definir el papel del derecho. Posteriormente, apoyándonos en este marco conceptual y analizando algunos elementos clave en el desarrollo de la industria Fintech actual, podremos inducir cuales son los principales retos a los que el derecho debe hacer frente. En este sentido, este trabajo contribuye al movimiento de política legislativa sobre las nuevas tecnologías financieras conocido como Regtech .

The present work contributes to the reflection on the regulation of the Fintech industry based on the great ideas of the financial theory, providing a conceptual framework that allows to understand and define the role of law. Later, based on this conceptual framework and analyzing some key elements in the development of the current Fintech industry, we will be able to induce what are the main challenges that the law has to face. In this sense, this work contributes to the legislative policy movement on the new financial technologies known as "Regtech".
