Abstract
el inexorable avance de las Tecnologías de la Información y el deseo de las instituciones europeas por hacer de Europa un referente en el ámbito dela comercio electrónico y la contratación digital; han llevado al legislador europeo a preguntarse por la legalidad de las prácticas del bloqueo geográfico injustificado. Este fenómeno consiste en impedir el acceso a contenidos en línea en función del territorio desde el que se está operando, así como modificar ciertas condiciones esenciales de la contratación (precios, productos, políticas de envió y transporte…) Ante el obstáculo que esto supone para la creación de un mercado único digital, se promulgó el pasado año el Reglamento 2018/302 para eliminar este fenómeno negativo. Sin embargo, la falta de armonización de la legislación del entorno digital, así como los intereses económicos subyacentes hacen preguntarse si dicho instrumento europeo es la solución más adecuada. the inexorable advance of Information Technologies and the desire of European Institutions to make Europe a benchmark in the field of electronic commerce and digital contracting; had led the European legislator to question the legality of unjustified geographical blockade practices. This phenomenon consists of preventing access to online content depending on the territory from which it is operating, as well as modifying certain essential conditions of the contract (prices, products, shipping and transport policies ...) Given the obstacle that this entails for the creation of a digital single market, Regulation 2018/302 was enacted last year to eliminate this negative phenomenon. However, the lack of harmonization of the legislation of the digital environment, as well as the underlying economic interests, raise the question of whether this European instrument is the most appropriate solution.
