Análisis crítico del anteproyecto de Ley por la que se reforma la legislación civil y procesal en materia de discapacidad
Abstract
Según datos de la Organización Mundial de la Salud (OMS) alrededor de 1000 millones de personas en el mundo padecen algún tipo de discapacidad, lo que supone un quince por ciento de la población mundial. Son muchos los hombres, mujeres, y niños que sufren alguna discapacidad y participan en actos de la vida cotidiana, sin embargo, también existe un número de ellos, que en cierta medida sufre algún tipo de discriminación por este hecho. Con la promulgación del Anteproyecto de Ley por la que se reforma la legislación civil y procesal en materia de discapacidad, así como otras leyes al respecto tales como el Convenio de Nueva York de 2006, la Ley 26/2011 de adaptación de la normativa a la Convención Internacional sobre los Derechos de las Personas con discapacidad, el Real Decreto 1/2013 de 29 de noviembre o la Ley Orgánica 1/2017 de 13 de diciembre, en la que se garantiza la participación de las personas con discapacidad en los tribunales Jurado, se pretende acercar a la sociedad la marginación que en ocasiones sufren estas personas. Lo que se pretende con estas leyes es, que en la medida en la que sea posible y siempre diferenciando entre los distintos grados de discapacidades y buscando lo mejor para este colectivo, tratar de eliminar la discriminación negativa que en determinados momentos sufren. According to data from the World Health Organization (WHO) about 1 billion people in the world suffer from some kind of disability, which accounts for fifteen percent of the world's population. There are many men, women and children who suffer some kind of disability and participate in everyday life, however, there are also a number of them who to some extent suffer some kind of discrimination because of this fact. With the enactment of the Draft Law reforming civil and procedural legislation on disability, as well as other relevant laws such as the 2006 New York Convention, Law 26/2011 adapting the regulations to the International Convention on the Rights of Persons with Disabilities, Royal Decree 1/2013 of 29 November or Organic Law 1/2017 of 13 December, which guarantees the participation of persons with disabilities in sworn courts, the aim is to bring society closer to the marginalization that these persons sometimes suffer. The aim of these laws is that, as far as possible, and always differentiating between the different degrees of disability, and seeking the best for this group, try to eliminate the negative discrimination they suffer at certain times.
