Participación de la fiscalía en asuntos político-sociales y administrativos: nuevos límites a la independencia del sistema judicial.

Abstract

El Ministerio Fiscal es un órgano dependiente jerárquicamente del Poder Judicial cuya función principal es la de promover la acción de la Justicia en favor del interés público. La importancia de este concepto es, en varios sentidos, el objeto de este trabajo. En primer lugar, se trata el concepto, la organización de la Fiscalía; la General, las especiales y las especializadas, y sus funciones. Comienza entonces el planteamiento acerca de su relación con los Poderes Ejecutivo y Judicial, guardando un apartado al Consejo General del Poder Judicial junto a la controversia que existe en los últimos tiempos, que ha llevado a la sociedad a la vez que a los medios de comunicación a dudar de su carácter independiente. Por otro lado, se analiza en concreto la participación del Ministerio Fiscal en los asuntos Contencioso-Administrativos, políticos y sociales de nuestros días, explicando primero su evolución y contexto en el primer caso, para más tarde reflexionar acerca de la evolución y el papel trascendente que ha obtenido entre la sociedad y el gobierno español. Los siguientes capítulos son más específicos, en los que sigue la reflexión de la participación de la Fiscalía en las Comunidades Autónomas aforadas desde un punto de vista administrativo y político-social, así como se desarrolla previamente el significado en la existencia de algunas Fiscalías especializadas, tales como la de Anticorrupción o la de Tráfico. En estos dos puntos las líneas invitan a reflexionar acerca de los distintos intereses sociales. En el Capítulo final, la autora realiza una conclusión basada en todos los aspectos que ha abarcado su investigación y sobre todo acerca del futuro de esta institución y de su papel trascendental; no sólo desde su creación hasta la actualidad, sino también en el futuro más próximo.

The Public Prosecutor's Office is a hierarchically dependent body of the Judicial Branch whose main function is to promote the action of Justice in favor of the public interest. The importance of this concept is, in several senses, the object of this work. First, it deals with the concept, the organization of the Office of the Prosecutor; the General, special and specialized, and their functions. Then begins the approach about its relationship with the Executive and Judicial Powers, keeping a section to the General Council of the Judiciary together with the controversy that exists in recent times, which has led to society as well as the media to doubt its independent character. On the other hand, the participation of the Public Prosecutor's Office in the Contentious-Administrative, political and social issues of our days is analyzed, explaining first its evolution and context in the first case, to later reflect on the evolution and the transcendent role he has obtained between society and the Spanish government. The following chapters are more specific, in which follows the reflection of the participation of the Office of the Prosecutor in the Autonomous Communities assessed from an administrative and socio-political point of view, as well as the meaning in the existence of some specialized prosecutor's offices, such as Anti-corruption or Traffic. In these two points, the lines invite us to reflect on the different social interests. In the final chapter, the author makes a conclusion based on all the aspects that her research has covered and above all about the future of this institution and its transcendental role; not only from its creation to the present, but also in the nearest future.
