Los derechos de los animales. especial atención a la regulación del maltrato animal en la legislación española

Abstract

La regulación en términos de protección animal en España sigue careciendo de muchos aspectos estructurales que son necesarios para construir un derecho animal sólido, y es por ello por lo que se hace esencial la adopción de medidas encaminadas a otorgar a los animales la protección que merecen. Este trabajo de Fin de Grado está dividido en dos bloques: en el primero de ellos se realizará un breve recorrido sobre la historia del maltrato animal en términos filosóficos y legales para, posteriormente, analizar la regulación actual del maltrato animal en nuestro país, con sus fortalezas y sus debilidades. Se observará que, aunque se están dando pasos en una dirección correcta hacia la protección animal mediante la incorporación de estándares europeos o reformas del Código Penal beneficiosas para los animales, queda aún mucho camino por recorrer para poder hablar de un ‘derecho animal’ en términos generales. El segundo bloque, por su parte, abordará el debate filosófico y moral sobre la cuestión de si deberían los animales ser sujetos titulares de derechos o no, destacando el papel fundamental que tiene el Estado en la concienciación sobre la protección del mundo animal.

Regulation in terms of animal protection in Spain still lacks several base aspects that are required to create a solid animal low, which is why it is essential to take action in order to bring animals the protection they deserve. This dissertation is divided into two parts: the first one will look over the history of animal abuse in philosophical and legal terms and will also analyze the current regulation of animal abuse in Spain, outlining its strengths and weaknesses. We will observe that, although some steps have been taken in the right direction towards animal protection thanks to the incorporation of European standards and beneficial Penal Code reforms, there is still a long way to go if we want to talk about an ‘Animal Law’ in general terms. The second part of the dissertation will address the philosophical and moral debate relating to the issue of considering animals as subjects who are able to have rights, outlining the important role of the state in raising awareness about the protection of the animal world.
