El excepcionalismo estadounidense en el Derecho Internacional

Abstract

El presente trabajo trata de analizar el excepcionalismo norteamericano en el ámbito del Derecho internacional público, cuestión de gran trascendencia desde hace varias décadas en la esfera global. De este modo, se llevará a cabo un estudio exhaustivo, comenzando con el desarrollo del fenómeno a lo largo de la historia, profundizando en las bases y motivos que lo sustentan. Posteriormente, tras dar a conocer los principales tratados no firmados o ratificados por Estados Unidos en materia de derechos humanos y medio ambiente, lo cual ejemplifica su posición excepcional, se llegará a la parte final del trabajo. En esta, se analizará la que se considera como la causa fundamental de este fenómeno, y, tras considerar brevemente la opinión pública estadounidense acerca de la cuestión, se considerarán las controvertidas políticas de la administración del presidente Donald J. Trump en la política exterior de Estados Unidos. Todo esto, sin entrar en críticas a ideologías evitando la politización del trabajo.

This End-of-Degree project is about analyzing the american exceptionalism in the field of public international law, a topic of great relevance for several years ago in the global atmosphere. In this way, it has been carried out an exhaustive study, beginning with the evolution of the phenomenon throughout history, deepening in the bases and the reasons that support it. Subsequently, after showing the principal treaties not signed by USA regarding human rights and environment, the final chapter will turn up. There, it will be analyzed what is considered the main cause of this phenomenon, and, after briefly examining the public opinion about the issue, it will be considered the controversial foreign policies taken by the administration of President Donald J. Trump. All this, without going into critics to certain ideologies, avoiding the politicization of the tesis.
