La responsabilidad civil por daños en el matrimonio. Análisis del incumplimiento de la promesa de matrimonio, el deber de fidelidad y la ocultación de la paternidad biológica

Abstract

En este trabajo vamos a ahondar en un tema tan antiguo como la existencia del ser humano. El matrimonio. Concretamente, en lo que sucede cuando ese cuento de hadas al que nos tienen acostumbrados empieza a flaquear ¿Qué pasa si el príncipe promete ir a rescatar a la princesa del dragón y luego decide quedarse en casa practicando sus dotes de espadachín?, ¿Y si la princesa se casa con el príncipe pero se queda embarazada del escudero? Todas estas cuestiones las intentaremos resolver, de una manera un poco más realista que Walt Disney, mediante el análisis del alcance del Derecho de Familia frente a los artículos 1.902 y 1.895 del Código Civil. Apoyaremos, además, nuestros argumentos en diferentes posturas doctrinales, jurisprudencia. Todo esto irá acompañado de una pequeña evolución histórica sobre el tema.

This study will be about a certain topic that has been around for as long as mankind. Marriage, that is. Specifically, it will be about what happens when that so promised fairy tale starts to falter. What happens if the prince, who promised he was going to rescue the princess from the dragon, stays at home, practising his swordsman ́s skills instead? And what happens if the princess marries the prince but gets pregnant from the squire? We will try to solve these questions through a more realistic approach than Walt Disney ́s, through the thorough analysis of the application of Family Law as opposed to the application of articles 1.902 and 1.895 of the Civil Code. Furthermore, we will support our arguments with different authors ́ opinions and case law. All of this will be introduced by a short historical development on the subject.
