Perfiles de pederastas: a partir de la literatura científica y del análisis de sentencias penales

Abstract

Los términos “pedofilia” y “pederastia” son términos que se confunden con facilidad. El primero hace referencia a un trastorno parafílico, mientras que el segundo se refiere a la comisión de un delito. Este trabajo se centra en el estudio de los diferentes perfiles de pederastas gracias a las diferentes clasificaciones existentes sobre este tema, además de un estudio jurisprudencial de sentencias penales. Para ello, se ha hecho una revisión bibliográfica de la materia y se han escogido 100 sentencias. Las clasificaciones expuestas hacen referencia a diferentes temas tales como aspectos psicológicos; el rol del agresor en función de la relación con la víctima, así como en la localización del delito. De igual modo, algunas de las clasificaciones tratan de cómo se ha ejercido el delito; o cómo ha actuado el agresor para ejercer el delito. Asimismo, otras clasificaciones hacen distinción entre los agresores que forman parte del núcleo familiar y los que no. Y, por último, una clasificación hace referencia a la relación entre el consumo de pornografía infantil y los actos delictivos de carácter sexual a menores de edad. En relación al estudio jurisprudencial, se eligieron algunas de las clasificaciones nombradas y se aplicaron a100 sentencias. En este estudio se observó que se cumplen características definidas por diferentes autores, es decir, los agresores suelen ser varones de entre 30 y 50 años con profesiones que permiten estar cerca de menores. Además, la mayoría de los agresores forman parte del ámbito familiar del menor. Las clasificaciones más útiles para el estudio jurisprudencial han sido las que hacen referencia a cómo se ha ejercido el delito; a si el agresor forma parte del núcleo familiar del menor o no; y, el rol del agresor en función del tipo de relación que mantenía con la víctima. También se ha observado un patrón de conducta en las mujeres que han formado parte del delito, lo cual puede considerarse una vía de estudio futura.

The terms "pedophilia" and "pederasty" are terms that are easily confused. The prior refers to a paraphilic disorder, while the latter refers to the commission of a crime. The aim of this study is to know the different profiles of pederast described in the literature, and use these classifications to make a jurisprudential study of criminal sentences. For this, a bibliographic review of the subject has been made and 100 sentences have been chosen, 50 of them from the year 2018, and the other 50 from the year 2019. The classifications exposed refer to different topics such as psychological aspects; the role of the aggressor depending on the relationship with the victim, as well as on the location of the crime. Similarly, some of the classifications focus on how the crime has been practiced; or how the aggressor has acted to exercise the crime. Likewise, other classifications distinguish between aggressors who are part of the family nucleus and those who are not. And finally, some classifications refer to the relationship between the consumption of child pornography and criminal acts of a sexual nature against minors. In relation to the jurisprudential study, some of the named classifications were chosen and applied to the 100 chosen sentences. In this study, it was observed that characteristics defined by different authors are fulfilled like, the aggressors are usually men between 30 and 50 years old with professions that allow them to be close to minors. Furthermore, the majority of the aggressors are part of the minor's family environment. The most useful classifications for the jurisprudential study have been those that refer to how the crime has been practiced; if the aggressor is part of the minor's family nucleus or not; and, the role of the aggressor depending on the type of relationship he had with the victim. Carrying out this study, a pattern of behavior has been observed in women who have been part of the crime, which can be considered a future study path.
