Análisis de barrios marginales / Delitos de odio / Ley 1/2004

Abstract

El en el presente trabajo se muestra cómo se encuentra la problemática actual en España en materia de delitos de odio, concretamente hacia el colectivo LGTBI. En él, se hace una descripción detallada de qué son los delitos de odio y los constructos psicológicos que los subyacen. Se realiza una distinción entre delitos ordinarios y delitos de odio, siendo en estos últimos necesaria la presencia de 2 elementos: la motivación del autor y el prejuicio. Se hace un abordaje desde el punto de vista criminológico sobre la cifra negra, la tipología del agresor en función de la motivación y el tratamiento que reciben estos para su reinserción y reeducación en Instituciones Penitenciarias. Además, se exponen desde el punto de vista de la victimología los trastornos psicológicos asociados que presentan las víctimas de estos delitos. Finalmente, se incluye una introducción al colectivo LGTBI y al vocabulario asociado al mismo.

The following work shows how the current problems in hate crimes in Spain are, specifically towards the LGTBI community. Also, what hate crimes are and the psychological constructs that underlie them have been descripted in detail. It is included a distinction between ordinary and hate crimes, where the presence of two elements are necessary in the last ones: the motivation of the perpetrator and prejudice. Furthermore, an approach from the criminological point of view of the “unrecorded” crime rate or “dark figure”, the typology of the perpetrator based on the motivation and the treatment they receive for their reintegration and re-education in Penitentiary Institutions are boarded. In addition, the associated psychological disorders exposed by victims of these crimes are presented from the point of view of victimology. Finally, an introduction to the LGTBI community and the associated vocabulary are included.
