Úteros artificiales : estudio sobre los retos legales en materia de aborto y gestación por sustitución planteados por los últimos avances científicos
Abstract
Los recientes avances científicos demuestran que los úteros artificiales serán pronto una realidad. El éxito en la gestación de corderos prematuros dentro de un dispositivo conocido como “biobolsa” en el Children’s Hospital of Philadelphia es particularmente prometedor. La posibilidad de gestar fetos fuera del vientre materno gracias a esta nueva tecnología traerá numerosos retos en el plano jurídico: la regulación del aborto y de la gestación por sustitución son dos de los ámbitos que se verán más afectados. Todo ello lleva a analizar la existencia de un supuesto derecho a la autonomía procreativa, es decir, a plantear si pueden existir el derecho a reproducirse y el derecho a no hacerlo.
Las respuestas que los diferentes países den a esta cuestión dependerá enormemente de sus Constituciones y de sus regulaciones actuales. El aborto es un derecho reconocido en la gran mayoría de Estados occidentales, Estados Unidos y España entre ellos. La gestación por sustitución presenta regulaciones mucho más dispares en los países. España la prohíbe, mientras que algunos Estados de Estados Unidos, como California, la permiten incluso en su modalidad comercial. Todas estas divergencias legislativas y jurisprudenciales tendrán una gran influencia en el futuro de los derechos reproductivos. Legisladores y jueces deberán esforzarse por delimitar los parámetros constitucionales para evitar que los úteros artificiales lleven al caos. Recent scientific developments have proven that artificial wombs will soon be a reality. The successful gestation of premature lambs in a “biobag” in the Children’s Hospital of Philadelphia is particularly promising. The possibility of gestating fetuses outside the woman’s womb thanks to this new technology will pose legal challenges: abortion and surrogacy’s regulation are some of the fields that are likely to become more impacted. All these things lead to analyzing the hypothetical existence of a right to procreational autonomy, that is, to question whether a right to be a parent and a right not to be a parent might exist.
The answers that several countries give to this issue will heavily depend on their Constitutions and current regulations. Abortion is a right that has been recognized in most occidental States, the United States and Spain being among them. Surrogacy, however, relies on a wide range of regulations internationally. Spain forbids surrogacy, whilst several States of the U.S., such as California, allow it – even in the commercial category. All these regulatory and doctrinal divergences will decisively influence the future of reproductive rights. Legislators and the Judiciary must endeavor to limit the constitutional parameters so as to prevent artificial wombs from leading to chaos.
