La promesa de matrimonio y la necesidad de su regulación en el siglo XXI

Abstract

En este trabajo se propone una temprana y urgente modificación del Código Civil Español vigente en lo referente a los artículos que versan sobre el incumplimiento de la promesa matrimonial, con el fin de que se adapten a la realidad social actual, además de incluir en dicha redacción un listado de casos particulares para que cada sujeto jurídico se encuentre amparado y protegido por nuestro ordenamiento jurídico. El objetivo no será otro que evitar que tanto los futuros contrayentes como personas vinculadas con dicha promesa matrimonial, en caso de incumplimiento de la misma, sepan hacerlo de la manera correcta, para evitar, así, importantes consecuencias derivadas de tal negocio jurídico, pues, algunas situaciones sí estarán amparadas por el derecho a la libertad nupcial, mientras que otras, las causantes de tales responsabilidades jurídicas, no lo estarán. Para lograrlo, todos los participantes deberán tratar al incumplimiento de la promesa matrimonial con la seriedad que se merece, pues es de carácter contractual.

This work proposes an early and urgent modification of the Spanish Civil Code in force in relation to the articles dealing with the breach of the marriage promise, in order to adapt them to the current social reality, in addition to including in said wording a list of particular cases so that each legal subject is protected by our legal system. The objective will be none other than to prevent both future spouses and persons linked to said marriage promise, in the event of non-compliance with it, from knowing how to do it in the correct way, to avoid, in this way, important consequences derived from such legal business, since, some situations will be protected by the right to marital liberty, while others, the cause of such legal responsibilities, will not be. To achieve this, all participants must treat the breach of the marriage promise with the seriousness it deserves, as it is contractual.
