Estatuto de la Corona en España. Análisis de una posible reforma de sus competencias y prerrogativas recogidas en el Título II de la Constitución

Abstract

Durante las dos ultimas décadas han sido frecuentes las propuestas de una relectura de la Constitución Española del 78; entre ellas se halla la reforma del texto que la Constitución dedica a la Corona. En la sociedad española actual, la figura del Rey se halla sometida a debate. Son varias las cuestiones planteadas en relación con la monarquía parlamentaria en España. A lo largo del presente trabajo de fin de grado se pretende exponer y argumentar las razones que abogan por una reforma del Titulo II de Constitución que arroje concreción, transparencia y seguridad a los poderes constitucionales del Rey o Reina, y en su caso el/la Regente, en el ámbito de sus competencias y prerrogativas. Todo ello con el objetivo de ofrecer una respuesta eficaz a los interrogantes y reflexiones que han surgido durante años/últimamente, en relación con la Corona y que en estos momentos arrecian en la sociedad española. En particular, las recientes circunstancias políticas por las que ha atravesado nuestro país en relación con la necesidad de proveer en tiempo y forma oportuna la jefatura del gobierno, reclaman poner punto y final a la escasez normativa reguladora de esta materia, tal y como aparece reflejada en la Constitución.

During the last two decades there have been frequent proposals for a new appraisal of the Spanish Constitution of 1978; the reform of the text that the Constitution dedicates to the Crown may be counted among them. In the present Spanish society, the figure of the King is under debate. Throughout this final degree project, it is intended to expose and to argue the reasons which advocate a reform of Title II of the Constitution in connection with the essence, transparency and stability of the King’s, Queen’s, or Regent’s constitutional competences, within the scope of his/her powers and prerogatives. All this with an aim to present effective answers to questions that have been recently arisen in relation to the Crown and that are currently under debate in the Spanish society. In particular, the recent political circumstances that our country has gone through in relation to the need to provide the head of government in a timely and operative manner, have paved the way for an increasing social request in favor of the unfolding of the excessively brief regulation, with which the Constitution contemplates this matter.
