El proceso catalán y el problema constitucional

Abstract

La organización territorial prevista en nuestra Constitución se ha visto cuestionada en los últimos años como consecuencia de altos desequilibrios y sucesos ocurridos en distintas regiones del territorio español. Esto ha llevado a plantearse la eficacia y adecuación de lo establecido en el 78. Quizá lo que se planteó en su momento ya no resulta suficiente o no se ajusta a la realidad de la sociedad española actualmente. El presente trabajo busca estudiar a fondo esta materia, desde cómo se quiso establecer dicho sistema y como se ha ido configurando hasta llegar al modelo autonómico que conocemos ahora. Se quiere contar con el apoyo fundamental de la postura y doctrina que ha ido asentando al respecto el Tribunal Constitucional. Asimismo, como ejemplo de los desajustes vividos en este país entorno a esta materia, se desea estudiar el caso catalán con sus pretensiones y posibles soluciones. De esta forma, mediante dicho estudio y análisis se ha querido aportar las soluciones, mejoras o posibles alternativas al actual modelo territorial que tiene el Estado español. En cualquier caso, la presente materia constituye indudablemente una de las mayores incertidumbres que tiene el Estado español actualmente y cuya resolución condicionará el futuro del mismo. Es por ello por lo que se considera esencial y necesarias este tipo de investigaciones al respecto.

The territorial organization which is provided in our current Constitution has been questioned in recent years as a result of high imbalances and events in different regions of Spain. This has led us to the question of the real effectiveness and adequacy of the provisions of what was established in 1978. Maybe what was proposed at that time is no longer sufficient or does not adapt to the reality of Spanish society today. The present work seeks to study this subject in depth, from how the system was established and how it has been configured until it reaches the autonomic model that we all know today. It has been wanted to have the fundamental support of the position and doctrine that our Constitutional Court has been establishing in this respect. As an example of these imbalances experienced in our country regarding this matter, we wish to study the Catalan case with its claims and possible solutions. In this way, through this study and analysis, the aim has been to provide solutions, improvements or possible alternatives to the current territorial model of the Spanish State. In any case, the present matter undoubtedly constitutes one of the greatest uncertainties that the Spanish State has at present and whose resolution will definitely condition its future. This is why this type of research is considered essential and necessary.
