La Constitución de 1978 y su aplicación en la lucha antiterrorista.

Abstract

Tras cumplir el 40 aniversario de la Constitución Española, resulta interesante hacer balance de uno de los grandes desafíos a los que se enfrenta la sociedad española: el terrorismo. La lucha contra el terrorismo ha marcado la vida de muchos españoles y supone una significativa amenaza para el Estado de Derecho y de Bienestar. La Carta Magna se consagra como el elemento clave para la lucha antiterrorista pues recoge en sus artículos medidas para combatir este fenómeno en busca de una sociedad cívica, unidad política, cooperación internacional y eficacia policial. Asimismo, cabe reflexionar sobre los límites que establece la Constitución a la hora de adoptar medidas extraordinarias para velar por la seguridad colectiva.

After celebrating the 40th anniversary of the Spanish Constitution, it is interesting to take balance of one of the great challenges facing Spanish society: terrorism. The fight against terrorism has marked the life of many Spaniards and poses a significant threat to the rule of law and welfare. The Magna Carta is consecrated as the key element for the fight against terrorism since it includes in its articles measures to combat this phenomenon in search of a civic society, political unity, international cooperation and police effectiveness. It is also worth reflecting on the limits established by the Constitution when it comes to adopting extraordinary measures to ensure collective security.
