Impacto de la economía colaborativa en las relaciones laborales. El derecho comparado en la materia

Abstract

La economía colaborativa está aquí para quedarse y ello supone muchos cambios a nivel social, político y económico que lleva inevitablemente a una adaptación jurídica de las consecuencias de estos nuevos modelos de negocio. El Derecho de las Relaciones Laborales es uno de los ámbitos más afectados y que a su vez, más afecta a la sociedad. Por ello, es importante estudiar cómo se ve afectado éste por la prestación de servicios mediante las plataformas virtuales, las alternativas que ofrece nuestro actual ordenamiento jurídico, si es conveniente o no desarrollar una legislación específica al respecto, y cómo otros países están afrontando esta nueva realidad. Todo lo anterior se estudia en este trabajo, presentando posibles alternativas que se pudieran adaptar a esta realidad y dando a conocer los casos más relevantes de calificación jurídica de este tipo de prestaciones de servicios a nivel internacional.

The sharing economy is here to stay and this implies many changes at a social, political and economic level that inevitably entail a legal adaptation of the consequences of these new business models. Labor Law is one of the most affected branch of law and, at the same time, this may affect the most to society. Therefore, it is important to study how Labor Law is affected by the provision of services through virtual platforms, the alternatives offered by our current legal system, whether or not it is convenient to develop specific legislation in this regard, and how other countries are facing this new reality. All of the above is studied in this work, presenting possible alternatives that adapt to this reality and publicizing the most relevant cases of legal qualification of this type of service provision at an international level.
