Abstract

4ResumenEl Estado supone el modelo de regulación social por antonomasia. Existe para dar cabida a los individuos y amparar la existencia mutua. El Derecho constituye el fundamento de la vida organizada de manera regulada. No puede concebirse una sociedad sin Derecho. Las comunidades humanas han coexistido aplicando reglas básicas de conducta desde cuando se tiene constancia escrita y sin embargo sigue siendo a día de hoy uno de los puntos de fricción social latente en nuestra sociedad. El Derecho al igual que los demás ámbitos humanos ha evolucionado conforme lo ha ido haciendo el Ser Humano. Sin embargo sigue habiendo grandes abusos y posiciones contrapuestas sobre la mejor manera de llevar a cabo dicha regulación. Para abordar esta temática se comenzará por sentar unasbases teóricas sobre lo que es el Derecho y su papel en la sociedad. Un recorrido histórico por algunas de las ideas que han vertebrado dicho sistema junto con algunas corrientes actuales como la concepción de un Derecho enmarcado en un sistema Constitucional.

The State supposes the model of social regulation par excellence. It exists to accommodate individuals and protect mutual existence. Law constitutes the foundation of organized life in a regulated manner. A society without law cannot be conceived. Human communities have coexisted applying basic rules of conduct for as long as there is written evidence,and yet it remains one of the latent points of social friction in our society today. Law, like other human devices, has evolved according to what the Human Being has been doing. However, there are still great abuses and conflicting positions on the best way to carry out such regulation.To address this issue, we will begin by laying a theoretical foundation on what Law is and its role in society. A historical journey through some of the ideas that have structured this system together with some current trends such as the conception of a Law framed in a Constitutional system.
