La fianza en el Derecho romano y su influencia en el Derecho Civil español

Abstract

En este Trabajo Fin de Grado se lleva a cabo un estudio histórico-jurídico de la fianza en el Derecho Romano y se analiza su influencia en el Derecho civil actual. Para ello, este documento analiza la figura jurídica de la fianza en la Antigua Roma, tanto sus antecedentes y orígenes como su desarrollo y evolución a lo largo de las etapas del Derecho romano. Además, se estudiará a su vez la figura actual analizando, por un lado, como consideraciones previas, el concepto de garantía personal y, por otro lado, la fianza que aparece recogida en el Código Civil. El trabajo concluye con la comprobación de cómo ha influido y en qué aspectos se puede apreciar la tradición romana en una institución tan común como es la fianza en el Derecho civil español.

In this Final Degree Project, a historical-legal study of the surety in Roman Law is carried out and its influence on current civil law is analyzed. To this end, this paper analyzes the legal figure of the bond in Ancient Rome, both its background and origins as well as its development and evolution throughout the stages of Roman Law. In addition, the current figure will be studied by analyzing, on the one hand, as previous considerations, the concept of personal guarantee and, on the other hand, the bond that appears in the Civil Code. The work concludes with the verification of how the Roman tradition has influenced and in what aspects it can be appreciated in such a common institution as the surety in Spanish Civil Law.
