Abstract

El Trabajo que se presenta gira en torno a un caso práctico con diez cuestiones principales acerca de contratación civil, derecho inmobiliario y un contrato de opción de compra para una potencial compraventa. Para ello, habrá de elaborarse un informe jurídico o dictamen resolviendo todas las cuestiones planteadas por el cliente del caso, desde el punto de vista del abogado consultado. Éstas deben resolverse utilizando la legislación vigente española y la jurisprudencia, así como la doctrina existente si es el caso, mediante las cuales deben justificarse las respuestas y conclusiones. Después de resolver las cuestiones planteadas, se redactarán una serie de conclusiones finales que recogerán los puntos principales del caso y una serie de recomendaciones con el objetivo de acercar el caso y ayudar a comprender las soluciones aportadas.

Se deberá tener en cuenta para ello también que aún seguimos inmersos en la crisis provocada por la pandemia y con medidas establecidas en conjunto con el estado de alarma, por lo que, aún no conocemos las verdaderas dimensiones de la misma ni los criterios que van a establecer de forma definitiva nuestros Tribunales en los próximos meses y años. En todo caso, esta situación ha dificultado los negocios y la situación tanto de personas físicas como de empresas y sociedades, y deben de resolverse los conflictos de una forma lo más equilibradamente posible entre las partes y siempre de acuerdo con la normativa aprobada en el último año y con ayuda de la jurisprudencia establecida.

The Work that is presented revolves around a practical case with ten main questions about civil contracts, real estate law and a purchase option contract for a potential sale. For this, a legal report or opinion must be prepared, resolving all the questions raised by the client of the case, from the point of view of the lawyer consulted. These must be resolved using current Spanish legislation and jurisprudence, as well as existing doctrine if applicable, by which the answers and conclusions must be justified. After solving the questions raised, a series of final conclusions will be drawn up that will collect the main points of the case and a series of recommendations with the aim of bringing the case closer and helping to understand the solutions provided.

For this, it should also be taken into account that we are still immersed in the crisis caused by the pandemic and with measures established in conjunction with the state of alarm, so we still do not know the true dimensions of it or the criteria that will definitively establish our Courts in the coming months and years. In any case, this situation has hampered business and the situation of both individuals and companies and companies, and conflicts must be resolved in the most balanced way possible between the parties and always in accordance with the regulations approved in the last year and with the help of established jurisprudence.
