Los verdaderos fines de las penas privativas de libertad : pena permanente revisable

Abstract

En este trabajo se muestra la evolución de las penas privativas de libertad y su función resocializadora, centrándonos en la pena de prisión en la actualidad. Se hace un profundo análisis sobre cómo afectan los medios de comunicación, el poder político y los ciudadanos en el endurecimiento de dichas penas, explicando el fenómeno del populismo punitivo. Del mismo modo explicamos cómo se ha ido abandonando el fin resocializador por un fin principalmente retributivo, según el cual lo que importa es castigar al reo por un lado, y por otro calmar los sentimientos de venganza de los ciudadanos. Todo el estudio está marcado por un claro tono crítico, finalizando con unas conclusiones y aportaciones personales en las que se muestra un cambio notable desde el inicio hasta el final del mismo.

It is shown in this essay the evolution of the penalties of deprivation of liberty and its social rehabilitation, focusing on the penalty of imprisonment nowadays. An in-depth analysis on how the media, the political power and the citizens affect the imposition of heavier penalties is done, explaining in addition the popular punitivism. Likewise, it is explained how the reincorporation into society has been abandoned by a retributive way instead, which stipulates that the important thing is on one hand punish the criminal, and on the other hand calm down the victim’s feelings of desire for revenge. All the study has been written critically, ending with some personal conclusions in which a change of perspective is shown from the start until the end of it.
