Medidas ético-legales frente al rechazo a las vacunas: de la información a la coerción

Abstract

La crisis social, económica y sanitaria provocada por la pandemia del COVID-19 desde principios del año 2020 ha supuesto un punto de inflexión en las sociedades modernas, en las que se han tambaleado sus cimientos y ha habido que replantearse todo tipo de cuestiones. En el ámbito sanitario, los esfuerzos de los gobiernos e instituciones de todo el mundo se basó desde el primer momento en encontrar una vacuna que pudiese poner fin a la pandemia y retomar la vida normal. Sin embargo, una parte de las sociedades no es favorable a la vacunación y, aun teniendo en cuenta la letalidad y transmisibilidad del virus, muchas personas rechazaron vacunarse.

Ante la trascendencia de tal discusión en la actualidad, el presente trabajo busca realizar un análisis exhaustivo del ordenamiento jurídico español para entender si por un lado, es posible aprobar una medida que obligue al conjunto de la sociedad a vacunarse y, por otro, que implicaciones tendría tal medida en los derechos fundamentales de las personas. Además, se realizará un estudio del ordenamiento jurídico de Estados Unidos para analizar qué respuesta da otro país occidental a esta problemática. Por último, se pretende evaluar el estado actual de nuestro ordenamiento jurídico para ver si la respuesta dada a esta pandemia ha sido la adecuada y si sería extrapolable a otras crisis sanitarias, o si por el contrario se requieren reformas que garanticen la salud pública en momentos delicados.

The social, economic and health crisis caused by the COVID-19 pandemic since the beginning of 2020 has been a turning point in modern societies, where the foundations have been shaken and all kinds of issues have had to be rethought. In the health field, the efforts of governments and institutions around the world have been based on finding a vaccine that could put an end to the pandemic and return to normal life. However, some parts of societies are not in favor of vaccination and, even considering the lethality and transmissibility of the virus, many people refused to be vaccinated.

Given the importance of this discussion at present, this study seeks to carry out an exhaustive analysis of the Spanish legal system in order to understand whether it is possible to approve a measure that obliges society to be vaccinated and, on the other hand, what implications such a measure would have on people's fundamental rights. In addition, a study of the legal system of the United States will be carried out to analyze the response of another Western country to this problem. Finally, the aim is to evaluate the current state of our legal system to see whether the response given to this pandemic has been adequate and whether it can be extrapolated to other health crises, or if, on the contrary, reforms are required to guarantee public health at delicate times.
