La eficacia civil de las resoluciones canónicas en los procesos por causas de nulidad matrimonial

Abstract

El tema de estudio de este trabajo son los pilares en los que se fundamenta el derecho matrimonial canónico. En primer lugar, se realizará un estudio exhaustivo que permitirá al lector comprender la figura del matrimonio en su conjunto, donde se incluirá su concepto, elementos esenciales, fines y propiedades del matrimonio, sacramentalidad y requisitos de validez. Posteriormente, se hará una clasificación y justificación de las numerosas causas de nulidad. Algunas de ellas por ausencia de consentimiento, o por vicio del mismo, otras por impedimentos objetivos o por defecto de forma. Otro aspecto que abordaremos es la posibilidad de convalidar un matrimonio nulo, es decir, los cónyuges tendrán la posibilidad de dar validez al matrimonio inválido a través de la renovación del consentimiento. A modo de conclusión realizaré un análisis del impacto en el ordenamiento civil de las resoluciones emitidas por los tribunales eclesiásticos, acabando la conclusión con una breve valoración crítica.

The subject of study of this work are the pillars on which canonical marriage law is based. First, an exhaustive study will be made that will allow the reader to understand the figure of marriage as a whole, including its concept, essential elements, purposes and properties of marriage, sacramentality and requirements of validity. Subsequently, a classification and justification of the numerous causes of nullity will be made. Some of them due to the absence of consent, or due to a defect of consent, others due to objective impediments or due to a defect of form. Another aspect that we will deal with is the possibility of validating a null marriage, that is to say, the spouses will have the possibility of giving validity to the invalid marriage through the renewal of the consent. By way of conclusion, I will analyze the impact on the civil system of the resolutions issued by the ecclesiastical courts, ending the conclusion with a brief critical assessment.
