El reparto competencial en materia de educación en España

Abstract

De entre los derechos fundamentales que garantiza nuestra Constitución, el derecho a la educación es uno de los más relevantes por ser palanca de desarrollo personal, laboral, social y económico, así como por ser condición de ejercicio de otros muchos derechos. El derecho a la educación ha sufrido fuertes vaivenes históricos hasta su concreción en la Constitución de 1978. Posteriormente, ha sido desarrollado por más de siete Leyes Orgánicas, las cuales han venido a modelar el sistema de distribución competencial entre Estado y Comunidades Autónomas en el ámbito educativo. Por otro lado, las diversas reformas de los Estatutos de Autonomía de la VIII legislatura han supuesto una redefinición total del sistema de distribución competencial en el ámbito educativo. Mediante el presente trabajo de investigación se pretende realizar una labor ordenadora del citado proceso oscilante de regulación en sede educativa para poder plantear los actuales problemas o deficiencias del sistema de distribución competencial en el ámbito educativo y ofrecer los elementos necesarios que permitan al lector general una opinión fundada en derecho sobre la materia.

Within the Fundamental Rights guaranteed by our Constitution, the right to education is one of the most relevant as it is a lever for personal, social and economic development and also a necessary condition for the exercise of many other rights. The right to education has historically suffered many changes and turnarounds until its recognition as a fundamental right in the 1978 Constitution. Subsequently, it has been developed thereafter by seven Organic Laws, which have shaped the system of competence distribution between central State and “Autonomous Communities”. Furthermore, the various reforms of the Statutes of Autonomy made in the VIII Legislature involved a total redefinition of the system of competence distribution in the scope of education. The research hereby tries order this oscillating process of regulating the education field in order to present the current problems or deficiencies in the system of competence distribution in the scope of education and provide the necessary elements to enable the reader to proffer an informed opinion on the matter.
